A lawsuit against the City of Jefferson will move to trial.
According to court documents, following a meeting between attorneys for the plaintiff, Roger Nielson and the defendants, the City of Jefferson, Dixon Construction, Union Pacific Railroad and Snyder and Associates have scheduled September 20, 2016 for civil court.
Nielson is seeking restitution for what he claims were property damages following a significant rain event on or about May 30, 2013 at 102 West McKinley Street. Nielson is accusing Dixon Construction of deficiencies in its construction of the overpass bridge, UP for not clearing debris or silt from its drainage ditch by Nielson’s property, Snyder and Associates for deficiencies in the design and construction of the bridge and the City of Jefferson for breaching its duty to act in accordance with a recognized engineering or safety standard in the design, construction maintenance of the bridge and drainage and storm sewer system. The City is further accused of causing past and future damage to Nielson’s property and constituting an inverse condemnation.
The petition was originally filed by Nielson with the Greene County District Court on May 27th.
