A Jefferson man who is accused of kidnapping will have his case continue through the court system.

According to court documents, a competency hearing was held on Tuesdayfor 34-year-old Brandon Duong. Duong is facing a Class B Felony charge for second degree kidnapping-armed with a dangerous weapon. On January 30th, Duong allegedly took his biological seven-year-old son from Greene County Elementary School without permission. There was a court order in place against Brandon from having custody of his son.

An Amber Alert was then sent out and Brandon’s vehicle was eventually found in Plymouth County and after a high speed chase ended. Court documents show that Brandon was found holding his son while carrying a rifle before he was arrested.

A psychiatric evaluation was court ordered to determine Brandon’s competency. On Tuesday, District Court Judge Adria Kester ruled that no evidence was found that Brandon was suffering from a mental disorder and that he was competent to stand trial. Judge Kester ordered that his case was to be resumed.
