A Carroll man has been sentenced in Guthrie County District Court after pleading guilty to an amended charge of fourth degree criminal mischief for driving his vehicle on a Panora resident’s yard.
Court documents show 41-year-old Nicholas Josef Kuiper was convicted of criminal mischief as well as operating while under the influence first offense, both serious misdemeanors. Kuiper was given a suspended 365-day sentence in the Guthrie County Jail, to be placed on one year of probation for each count, to be served concurrently. He must pay over $1,700 in fines and surcharges as well as full restitution for pecuniary damages. He must also complete a drinking drivers course, submit to a substance abuse and mental health evaluation, and his driver’s license has been revoked. A serious misdemeanor eluding charge was dismissed with costs taxed to Kuiper.
He was originally charged with second degree criminal mischief, a class D felony, for the November 15th, 2019 incident in which Kuiper crashed his Hummer into the gates of a residence located in the 2800 block of Highway 44 in Panora, and tore around the victim’s yard.
