A Jamaica woman that was recently acquitted on a second degree theft charge by a Guthrie County jury has pleaded guilty to another theft charge.

Court documents show 39-year-old Elisha Marie Mischke was convicted of an amended charge of fifth degree theft, a simple misdemeanor. She was sentenced to 30 days in the Guthrie County Jail with credit for 30 days already served. She must also pay a $65 fine and statutory 35% surcharge, $500 in restitution to the victim, and over $2,000 in legal and jail fees as well as court costs.

Mischke was originally charged with fourth degree theft, a serious misdemeanor, for an August 1st incident when she refused to refund $500 in earnest money to a victim for a real estate purchase that did not go through. A jury trial also found Mischke not guilty of a class D felony theft charge for a July 11th incident in which she was found to have allegedly sold three tractors that were not hers.
