A Bayard man was convicted and sentenced for several cases this week.

Court documents show that 24-year-old Brandon Richard Potter is convicted of third degree burglary, and gathering where controlled substances are unlawfully used, both class D felonies; two counts of possession of methamphetamine – second offense, an aggravated misdemeanor, and possession of marijuana – second offense, a serious misdemeanor. Potter was given five year suspended prison sentences for the two felony convictions and sentenced to three years probation for each. He was also given a suspended two year prison sentence and two years probation for each of the aggravated misdemeanors, and a suspended 365 days in jail sentence and one year of probation for the serious misdemeanor. Potter was also convicted for violating his probation on a possession of marijuana – first offense conviction and was sentenced to five days in jail and to remain on probation.

The felony sentences, and those for the single aggravated misdemeanor case and the probation violation are to be served consecutively. However, the sentences in the felony case that includes gathering where controlled substances are used are to be served concurrently. A count of gathering where marijuana is used and possession of drug paraphernalia were dismissed. Potter is also ordered to pay around a total of $7,000 in restitution, court costs, fees, and surcharges. These convictions stem from incidents that occurred on April 2nd and July 10th.
