A Michigan man has been sentenced in Guthrie County for charges of possession of contraband and operating while intoxicated following a June arrest.
According to court documents, 46-year-old Nicky Oliver Searfoss pled guilty to two counts of possession of contraband in a correctional facility, a class D felony; and operating while intoxicated first offense, a serious misdemeanor. A five-year prison sentence for each of the felony convictions were suspended and Searfoss was placed on two years probation for each offense. The remainder of a 365 day jail sentence for the OWI conviction will be suspended once Searfoss has served seven days, and then he will be placed on two years probation. The three sentences will be served concurrently. Searfoss must pay fines and restitution for all convictions. As per his plea agreement, the other charges of carrying weapons, possession of methamphetamine, and possession of marijuana have been dismissed.
This case stems from an incident in which a traffic stop was conducted for Searfoss in Stuart for having a cracked windshield and nonworking brake light. A glass pipe and knife measured just over five inches long were found. After he was arrested baggies of marijuana and meth were found on Searfoss while being booked at the Guthrie County Jail.
