A Jefferson man was sentenced to prison after pleading guilty to two separate incidents.
According to court documents, 43-year-old Branden Gerrick Smith pled guilty to two lesser charges of aggravated misdemeanors for second offenses of domestic assault. He also pled guilty to an aggravated misdemeanor for third degree criminal mischief and simple misdemeanors for interference with official acts and fifth degree criminal mischief. Smith was sentenced to up to two years in prison on each of the aggravated misdemeanor charges and 30 days in the Greene County Jail on each of the simple misdemeanors. The sentences are to run concurrently.
The charges stem from two separate domestic incidents on March 1st and April 4th. Smith was originally charged with two felonies for his third or subsequent offense for domestic abuse assault.
Greene County Attorney Thomas Laehn tells Raccoon Valley Radio he and the defense attorney agreed to the lesser charges from felonies for domestic abuse assault to aggravated misdemeanors and jointly agreed to prison time for both incidents. District Court Judge Joseph McCarville agreed with the plea agreement. Laehn adds that Smith was also federally indicted by a grand jury with a felon in possession of a firearm from one of the incidents that happened in Greene County.
Smith was also ordered to pay over $3,500 in court-appointed attorney fees, domestic abuse surcharge and court costs.
