A Boone man was arrested for an alleged drug possession incident in Greene County.
According to court documents, this past Tuesday a Greene County Sheriff’s Deputy was serving civil papers to a home in the 100 block of North Olive Street in Jefferson. As that was happening, the deputy recognized an individual, 48-year-old James Cunningham who was standing next to a vehicle, and knew he had an arrest warrant in Webster County.
Court documents show that as the warrant was being verified through dispatch with Webster County, the deputy saw Cunningham fidgeting with something inside a pocket of his sweatshirt. The deputy said in the report that Cunningham had been arrested on weapons charges before and had attempted to assault the deputy in the past. Out of safety, the deputy asked Cunningham to show his hands, and in one hand he had what appeared to be a smoking device.
Court documents show that once the warrant was confirmed, Cunningham was arrested and as he was being transported to the Greene County Jail, a preliminary test of the residue from the smoking device confirmed it was marijuana. Cunningham was then charged with a Class D Felony for his third or subsequent offense for possession of a controlled substance violation.
