Robert Montgomery
Two individuals face felony charges from an alleged sports wagering incident that happened at Wild Rose Casino in Jefferson.
According to court documents, the Iowa Division of Criminal Investigation investigated the incident that happened on November 7, 2021. Sixty-seven-year-old Robert Montgomery of Grand Junction placed five sports wagers and agreed to split the winnings with 50-year-old David Kersey of Ames. Montgomery told authorities that he knew Kersey had registered with the Iowa Racing and Gaming Commission’s Voluntary Self-Exclusion program, which was valid until January of 2024.
Kersey signed up for the program and had agreed to not claim, collect, take money or anything of value from sports wagering while at any of the state-ran casinos. Kersey agreed to split the winnings with Montgomery.
The investigation found that Montgomery agreed to place the wagers and collect the winnings with intent to defraud knowing Kersey could not collect the winnings. Kersey was also found to have violated the IRGC program because he didn’t forfeit any of the winnings he accepted, which is a condition of the program.
Montgomery was charged with a Class D Felony for conspiracy to commit a non-forcible felony and Kersey was charged with three Class D Felonies for gambling-false claim of winnings and a simple misdemeanor for his first offense for criminal trespass. Both were arrested Wednesday and booked into the Greene County Jail.
