The months-long saga of the break-in at the Dallas County Courthouse has reached a conclusion, with all charges dropped on the two men accused of the crime.

According to online court documents, on Thursday the Dallas County Attorney’s Office filed a motion to dismiss the charges of trespassing and possession of burglars tools filed against 29-year-old Justin Wynn of Naples, Florida, and 43-year-old Gary DeMercurio of Bothell, Washington. The two men are cybersecurity employees of the Colorado-based company Coalfire, which was contracted by the State Court Administration (SCA) to test the vulnerabilities of court records. At around 12:30 a.m. on September 11th, Wynn and DeMercurio were arrested at the courthouse in Adel by the Dallas County Sheriff’s Office, and initially charged with third-degree burglary, a class D felony.

The charges were later amended by County Attorney Chuck Sinnard, and now have been dropped altogether. The SCA apologized for the incident, and as a result adopted new policies for security testing which prohibit entry into courthouses outside business hours and physically breaking in. All the court costs will be assessed to the State.
