A Jefferson man has been sentenced to prison and awaits the outcome of another case that was committed in Greene County.

According to court documents, 43-year-old Jody Lyn Schad pled guilty to an amended charge of an aggravated misdemeanor for operating a motor vehicle without owner’s consent. He was sentenced to serve two years in prison and will be given credit for time already served. His sentence is to run concurrently with a probation revocation charge of a previous conviction and is also sentenced to serve two years in prison for violating his probation.

The charge stems from an incident on May 30th. Schad stole a motorcycle from the 700 block of North Cedar Street. He was also ordered to pay victim restitution, a law enforcement surcharge and court costs. Following the sentencing, Schad’s attorney filed for a new judge to preside over the case, due to Judge Joseph McCarville being a former attorney of Schad on previous Greene County cases, among other conflicts of interest.

Court documents show that Judge McCarville said he didn’t think any conflicts exists, but chose to recuse himself to avoid any appearance of impropriety. Judge Joseph Tofilon will be presiding over the case going forward.

Schad is awaiting one final sentence hearing where he has pled not guilty to a felony theft charge and misdemeanors for burglary and drugs for an unrelated incident. The sentence hearing is scheduled for April 12th.
