A federal court judge recently declared that the Affordable Care Act was unconstitutional citing that the individual mandate requiring people to buy health insurance can no longer be allowed, due to Congress’ tax reform.
Iowa’s Fourth Congressional District Representative Steve King serves as the House Judiciary Committee Chair and applauds Judge Reed O’Connor’s decision and adds that he’s argued that ACA has been unconstitutional since it was established. He points out that the issue could reach the US Supreme Court, which King believes that the reasons the highest court in the land gave then for ACA won’t hold any ground now.
“Chief Justice John Roberts rationalized that by saying, ‘Well it’s a tax, it’s not a penalty for not buying (health care). Well now that the tax has been repealed, that also means that the very core that the (US) Supreme Court used and allowed for the Obamacare to be rationalized as constitutional, that reason has been removed now, with the elimination of the individual mandate.”
In the meantime, King has a bill that he wants to push through the House that could help solve part of the health care issue for some Americans.
“(I have a bill) That provides for 100-percent deductibility for everybody’s health insurance premiums. Let’s let people buy catastrophic health insurance. If they can take a high deductible, a high co-payment, and a get a low premium, if they’ve got the capital that’s fine.”
King believes the current process of ACA moving through the court system may take up to one year to be resolved by the time it reaches the Supreme Court.
