Another one of the defendants in the Sabrina Ray case could be tried separately from the others, after her adoptive brother Justin Ray elected to withdraw his waiver of a speedy trial.

Tuesday morning, attorneys for the 21-year-old from Perry submitted a demand for a speedy trial, which he had originally declined. The judge assigned to the case for all five defendants, the Honorable Terry Rickers, said the trial must be set within 90 days of February 1st, meaning Justin will go to trial before May 2nd. Another defendant in the case, Sabrina’s adoptive cousin Josie Bousman, has agreed to testify against the other four suspects and will also be tried separately. Misty Ray, Marc Ray, and Carla Bousman, Sabrina’s adoptive parents and grandmother, will still be tried together, though their court date has been pushed back indefinitely.

The five individuals were arrested last year in connection to the death of 16-year-old Sabrina Ray. She was found unresponsive in the home of Marc and Misty Ray on May 12, 2017, and an autopsy showed she died of severe malnutrition. Justin is being charged on four felony charges, though the connection between him and the death of Sabrina isn’t confirmed. He is accused of drop-kicking his adoptive sister down a flight of stairs, resulting in charges including: one count of child endangerment resulting in serious injury, a class C felony; one count of child endangerment resulting in bodily injury, a class D felony; and two counts of willful injury causing bodily injury, a class D felony.
