A Carroll man was sentenced in Greene County District Court for a September incident.
According to court documents, 40 year-old Robert Staiert was sentenced to 30 days in jail and three years of probation, after pleading guilty to a Class D Felony for his fourth OWI.
The charge stems from September 22, 2015, when Staiert was seen eating at the Jefferson Hy-Vee Market Cafe when he passed out in a restroom. He was then backing up his vehicle a few times and fell asleep. Officers arrested him a short while later when Staiert stopped in the parking lot of the Casey’s General Store on Elm Street. He refused to take a test to check if he was under the influence of alcohol at the law enforcement center. He been previously convicted of an OWI in 1996, 2006 and 2008.
Court documents show that Staiert had his five-year prison term suspended to 30 days in jail with credit for time already served. His driver’s license is to be revoked for six years, must undergo a substance abuse program and complete the Drinking Driver’s School program. All other charges were dropped. He was ordered to pay over $4,200 in fines, court costs and surcharges.
